The Danish nautical charts and nautical publications produced and maintained by the Danish Geodata Agency are not released as free data and therefore remain protected.
The Danish Geodata Agency holds the copyright to its products and data, as well as the exclusive right to produce nautical charts within the Kingdom of Denmark, cf. Lov om stedbestemt information § 5, stk. 2. Therefore, a license must be obtained if a private individual, company, or public authority wishes to reproduce the Danish Geodata Agency’s products or data.
If the reproduction is used for commercial purposes on a larger scale, such as resale or distribution of products to third parties, a royalty-based license agreement must be entered into with the Danish Geodata Agency.
For reproduction on a smaller scale, it is necessary to obtain a single-use license in the form of a reproduction permit. Reproducing a nautical chart on a smaller scale means producing or recreating the chart in the same or an adapted form. A reproduction of a nautical chart may occur in various situations, for example when reproducing an extract of a nautical chart in a book, in reports, or for display in a museum exhibition.
As a general rule, permission is only granted to reproduce extracts of a nautical chart. Reproduction permits are also time-limited, based on an individual assessment in each specific case. The time limitation determines the period during which a Danish Geodata Agency product or dataset may be reproduced, printed, produced and/or made available or displayed to third parties. The determination of this period depends on the specific circumstances of the case.
